These Terms govern your use of bizi.agency and the services provided by Bizi Agency LLC.
By accessing our website or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
Bizi provides managed client acquisition services. We install, configure, and manage lead response, appointment booking, follow-up, and reputation systems on your behalf. The specific services, fees, and terms that apply to you are set out in your order or proposal, which forms part of this agreement.
Where we provide access to a platform as part of that service, we grant you a non-exclusive, non-transferable, revocable licence to use it for your internal business purposes for as long as you are a client. You may not copy, distribute, resell, or create derivative works from it.
If you provide Bizi with your mobile phone number, you may receive SMS text messages regarding our services, including business outreach, follow-up, and appointment scheduling.
Fees are as set out in your order or proposal, billed monthly in advance unless agreed otherwise. Services are month to month with no minimum term unless your order states otherwise. Fees exclude any third-party costs passed through at cost, which we tell you about before they are incurred.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorised use.
You agree to provide, within a reasonable time, the access we need to deliver the service. Depending on your services this may include access to your booking or practice management software, your Google Business Profile as a manager, and a signed Business Associate Agreement where you are a healthcare provider.
You confirm that any contact information you provide to us was lawfully obtained and that the people concerned have not asked you to stop contacting them.
Where a performance guarantee applies to your services, it is suspended for any period in which we do not have the access described above. We will tell you in writing when that happens.
Where we provide review generation services, we ask every eligible customer. We do not filter people out based on how satisfied they appear, we do not offer anything in exchange for a review, and we do not write, buy, or fabricate reviews. These practices breach platform policies and put your listing at risk.
Because we do not control what a customer writes or whether they write at all, we do not guarantee any particular rating. Any guarantee we offer relates to the number of reviews, not the score.
Either party may cancel with 30 days written notice. Fees already paid for the current period are not refunded except where a specific guarantee provides otherwise. On cancellation we hand back access to anything of yours we hold and stop all messaging within 2 business days.
Your business information, your customer data, and your business profiles remain yours. The systems, workflows, templates, and configurations we build to deliver the service remain ours, including where they were configured specifically for you.
In no event shall Bizi, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, resulting from your access to or use of, or inability to use, the services. This includes anything caused by a third-party platform being unavailable or changing its rules.
Our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability that cannot be limited by law.
Neither party will disclose the other's confidential information. This obligation survives the end of this agreement.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.
Bizi reserves the right to modify or discontinue the services, temporarily or permanently. We may revise these Terms at any time, and material changes will be notified with 30 days notice. By continuing to use the site or the services you agree to be bound by the then-current version.
